Welcome to Seraphine Inc. (“Seraphine,” “we,” “our,” or “us”). By accessing and using our website (seraphinejewelry.ca) and purchasing products from us, you agree to be bound by these Terms and Conditions (“T&Cs”). Please read them carefully, as they contain important information regarding your rights and obligations. If you do not agree to these T&Cs, you must not use this website.
Modifications to Terms
Seraphine Inc. reserves the right to modify or replace these T&Cs at any time, at our sole discretion, with or without notice. All changes will become effective immediately upon posting on our website, and your continued use constitutes your acceptance of the modified T&Cs. We encourage you to review these T&Cs whenever you use our website to stay informed of any updates.
Eligibility and Legal Compliance
By using this website, you represent and warrant that you are at least the age of majority in your jurisdiction and are legally capable of entering into binding agreements. You agree to comply with all applicable laws and regulations related to the use of this website and purchases made from Seraphine Inc.
Product Information and Availability
We strive to provide accurate information regarding our products, including descriptions, pricing, and availability. However, we do not warrant that product descriptions or other content on our website are error-free. If an error is found, we reserve the right to correct it without liability and to cancel any orders that may have been placed based on incorrect information.
Order Placement and Acceptance
By placing an order through our website, you make an offer to purchase the product(s) selected. Orders are subject to acceptance by Seraphine Inc. at our discretion.
After placing an order, you will receive an email acknowledgment. This does not constitute acceptance. We will confirm acceptance by sending you an Order Confirmation email, which finalizes the contract between us.
We reserve the right to cancel or refuse orders at any stage of the ordering process, including after payment, if we suspect fraudulent activity, a violation of these T&Cs, product unavailability, pricing errors, or any other issue. Any unauthorized resale of our products is prohibited and grounds for order refusal.
Pricing, Taxes, and Payment Terms
All prices for Seraphine Inc. products are listed in Canadian dollars (CAD) and exclude applicable taxes and shipping fees. Seraphine Inc. reserves the right to adjust product prices on our website at any time without prior notice. The final price charged will be the price displayed at checkout when you confirm your order by clicking the “Place Order” button.
We offer two interest free installements: a first down payment of 50% of the price displayed on our website, and a final payment adjusted based on the diamond’s final carat weight as verified by the IGI certificate, plus all applicable taxes base on the final value of the item. As the carat weight might vary slightly from the description provided on our website, the second payment will reflect this variation; however, the total amount payable will not exceed the price listed in the product description.
You will be notified of the second payment amount after we obtain the IGI certificate, and we will proceed to ship your item once the second payment is completed.
Sales taxes are calculated based on the shipping address provided and are in accordance with Canadian tax laws for domestic orders. For international orders, any additional duties, import taxes, tariffs, or fees will be the responsibility of the customer, based on the regulations of the destination country. Seraphine Inc. is not liable for any such additional charges or delays caused by customs.
All orders are payable in Canadian dollars. We accept Visa®, MasterCard®, American Express®, PayPal®, and Interac® as payment methods. Please ensure that your billing and shipping addresses match the payment method requirements.
Seraphine Inc. processes all payment information securely, in compliance with data protection laws and our Privacy Policy. By providing your payment details, you confirm that the payment method is valid and authorized for this transaction, and that all information provided (e.g., card number, billing address) is accurate. If your payment is declined, your order will not be processed, and Seraphine Inc. is not responsible for fees or delays imposed by your financial institution.
All transactions are processed in Canadian dollars. If your payment method is linked to a non-Canadian account, currency conversion fees and exchange rate differences may apply, depending on your financial institution’s policies. Seraphine Inc. is not liable for any such fees or exchange rate differences.
If you choose to pay with PayPal or Interac, please note that the terms and Privacy Policies of these providers may apply. Any additional fees charged by third-party providers are the customer’s responsibility.
Seraphine Inc. reserves the right to correct any errors or inaccuracies on our website, including pricing errors. In such cases, we may cancel affected orders and issue a full refund. You will be notified promptly if your order is affected.
Shipping and Delivery
Seraphine Inc. offers both domestic and international shipping. Estimated delivery timelines are provided at checkout, though they may vary based on location and external factors. We are not liable for delays once an item has been dispatched.
For items with certified diamonds please allow 6 to 8 weeks for shipping and 2 to 10 days for delivery, as all diamonds will be certified by the International Gemological Institute (IGI) prior to shipment. Each diamond will be shipped with its official IGI certificate for your assurance of quality.
Shipping fees are calculated based on your location and selected shipping method. For international shipments, the customer is responsible for any applicable duties, taxes, or import fees imposed by their country.
Products are insured up to the point of delivery. Once delivered, responsibility for the goods transfers to the buyer. Orders valued at over CAD $500 require a signature upon delivery for security purposes.
Order Cancellations
If you wish to cancel or modify your order, please contact us immediately, as changes can only be made within 24 hours after the order has been processed. If you need to return an item for any reason, you may do so by following our return policy, and we will issue a refund for your purchase.
Returns, Exchange and Refunds
Final Sale Items: Some items are marked as final sale and cannot be returned, exchanged, or refunded. These include custom orders, personalized or engraved items, resized items, and items bought on sale.
Eligibility for Returns: For items eligible for return, you may request a return within 14 days of delivery, provided that the items are unused, in their original condition, and include all original packaging, tags, and accessories. Returned items showing signs of wear, alteration, or damage will not be accepted and will be sent back to the customer at their expense.
Return Authorization: To initiate a return, please contact our customer service team at return@seraphinejewel.com to obtain a Return Authorization. Returns without prior authorization will not be accepted. Customers are responsible for return shipping costs unless the item received was incorrect or defective.
Return Shipping and Responsibility: Customers must carefully package and ship return items to ensure they arrive in good condition. We recommend using a trackable shipping service and purchase insurance. Should you choose not to purchase insurance, you will be held responsible for any damage incurred. Seraphine inc. cannot be held liable for returns without tracking or delivery confirmation verifying that the package was received at our store. Kindly package your returns in the original outer box or a sturdy alternative shipping box, using proper packing materials to ensure the items arrive at our store in good condition.
Inspection and Refund Processing: After receiving and inspecting the returned item, we will process a refund to the original payment method within 7 to 10 business days. Refunds may be delayed if additional verification is needed by your financial institution.
Recycling Fees: Seraphine Inc. reserves the right to charge a recycling fee of 500$ for returned items valued at under $10,000 CAD. This fee will be deducted from the refund amount and is determined based on the type and condition of the returned item. Please note that items valued at over 10,000CAD is not refundable, but we will offer one free resizing service.
Exchange : To exchange any egligible item, a restocking fee of 20% of the item’s value will be charged. The Buyer is responsible for all shipping costs associated with the exchange, and Seraphine is not liable for any shipping charges or related expenses.
Warranty and Repairs
Seraphine Inc. guarantees that all products sold on our website are free from manufacturing defects in materials and workmanship under normal use for a period of one (1) year from the date of purchase. This warranty is valid only for products purchased directly from Seraphine Inc. or authorized retailers.
This warranty covers only manufacturing defects, including issues with materials and craftsmanship. It does not cover damage resulting from normal wear and tear, accidents, misuse, unauthorized alterations, improper care, or negligence. Examples of exclusions include, but are not limited to, scratches, discoloration, dents, and loss of stones due to impact.
To make a warranty claim, please contact our customer service team at info@seraphinejewel.ca with proof of purchase, a description of the issue, and photographs of the product. Upon reviewing your claim, we will inform you of the next steps, which may include sending the product to us for inspection.
If the product is found to have a manufacturing defect covered under this warranty, Seraphine Inc. will, at its discretion, either repair or replace the item at no cost to you. If a replacement is necessary and the original product is no longer available, we may replace it with a comparable item of equal value.
The customer is responsible for covering the shipping cost to send the product to Seraphine Inc. for warranty assessment. If the claim is approved, Seraphine Inc. will cover the return shipping cost to send the repaired or replaced item back to the customer.
This limited warranty is exclusive and in place of all other warranties, whether express or implied, including warranties of merchantability and fitness for a particular purpose. Seraphine Inc. shall not be liable for any indirect, incidental, or consequential damages arising from the use of its products, even if advised of the possibility of such damages.
User Account Responsibility
You may choose to create an account on our website to facilitate future purchases and access certain features. By creating an account, you agree to provide true, accurate, current, and complete information. It is your responsibility to update your account information as necessary to maintain its accuracy and completeness.
You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to take all necessary precautions to prevent unauthorized access to your account, including logging out at the end of each session and avoiding the use of shared or public devices.
You are fully responsible for any activities that occur under your account, whether authorized by you or not. If you suspect that your account has been compromised or accessed without authorization, you must immediately notify us at info@seraphinejewelry.ca. Seraphine Inc. reserves the right to suspend or terminate accounts suspected of unauthorized use.
We reserve the right to suspend, limit, or terminate your account at any time, without prior notice, if we believe you have violated these T&Cs, provided false information, or engaged in fraudulent or unlawful behavior. Such action is taken at our sole discretion and may result in forfeiture of any promotional benefits or points associated with the account.
Seraphine Inc. disclaims any liability for losses, damages, or claims arising from your failure to comply with this section. You agree to hold Seraphine Inc. harmless for any unauthorized use or security breaches related to your account.
Intellectual Property Rights
All materials on this website, including text, images, graphics, logos, audio, video, and software (collectively, “Content”), are the property of Seraphine Inc. or our licensors and are protected by Canadian and international copyright, trademark, and intellectual property laws. Unauthorized use is strictly prohibited.
The “Seraphine” name, logo, and related trademarks are owned by Seraphine Inc. You are not granted any rights to use our Trademarks or trade dress for commercial or personal use without our express written consent.
We grant you a limited, revocable, non-transferable, non-exclusive license to access and make personal, non-commercial use of the Content. You may not:

Provisions that, by their nature, survive termination (including, but not limited to, intellectual property rights, liability limitations, and indemnification) will remain in effect.
Miscellaneous
These Terms and Conditions constitute the entire agreement between the parties concerning the subject matter herein and supersede all prior communications, negotiations, and agreements, whether oral or written. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. Waver
Failure or delay by Seraphine Inc. to enforce any provision of these Terms shall not be construed as a waiver of its rights to enforce the same or any other provision in the future. Any waiver of any provision must be in writing and signed by an authorized representative of Seraphine Inc. to be effective. Such a waiver shall only apply to the specific instance and purpose for which it was granted and shall not be construed as a continuing waiver of any other provision or right.
